Wornly is a marketplace where people buy and sell secondhand clothing. Wornly is operated by [LEGAL ENTITY NAME], [REGISTERED ADDRESS]. Contact: [CONTACT EMAIL].
We provide the platform. We are not the seller of any item listed here, and we do not own, inspect, or store the items being sold. By creating an account you agree to these terms.
You must be at least 13 years old. If you are under 18, you may only use Wornly with the involvement of a parent or guardian. You must give an accurate date of birth when signing up.
One account per person. Don't create accounts to get around a suspension.
You must own what you list and be legally allowed to sell it. Describe items honestly, including flaws, and use your own photos of the actual item.
Don't list counterfeits, unhygienic items, or anything illegal to sell. When an item sells, post it promptly using the prepaid label we provide. To sell, you also need to complete payment setup with our payments provider (Stripe) and add a return address for shipping labels.
When you buy, you enter into a contract with the seller, not with Wornly. Your payment is held securely until delivery is confirmed. If an item never arrives, or arrives significantly different from its description, report a problem within 48 hours of delivery (see section 9).
Shipping is bought through our carrier partner and split 50/50: at checkout you (the buyer) pay half of the real shipping cost on top of the item price, shown to you before you pay, and the seller pays the other half out of their payout.
Because of this split, an item priced too low to cover the seller's half of shipping cannot be purchased. Carrier prices are quoted at the time you buy and depend on the item's size and the delivery address.
Buyers pay the item price plus their half of shipping (and any applicable tax). Wornly charges the seller a platform fee of 10% of the item price plus a flat 30¢ per sale.
A seller's payout is the item price minus that platform fee and minus their half of shipping. Payouts are released after delivery is confirmed. New sellers (fewer than five completed sales) have funds held for a short additional period — currently 14 days after delivery — while they build a track record.
Be decent to each other. No harassment, hate speech, spam, or attempts to take payment outside the platform — off-platform payments lose you every protection described here.
We may remove listings, or suspend accounts, that break these rules.
Your photos and descriptions remain yours. You give us permission to display them on Wornly so your items can be shown and sold. If you believe something here infringes your copyright, contact us and we will review and remove it where appropriate.
Most problems are best solved by talking to the other person first. If that doesn't work, report the problem in the app within 48 hours of delivery. While we review a reported problem, we hold the seller's payout so funds aren't released until it's resolved.
We review reported problems case by case and may side with either party based on the evidence, including tracking and photos. Our resolution process is still developing, and outcomes are decided on the facts rather than by a fixed formula. If you paid by card and raise a dispute directly with your bank, that is handled through your card issuer's process.
You can stop using Wornly whenever you like and ask us to delete your account. We may need to keep some transaction records for tax and accounting; where we do, we remove your personal details and keep only the record of the transaction. Account deletion isn't possible while you have an order still in progress.
Wornly is a venue that connects buyers and sellers. We don't make, own, or inspect the items, and we can't guarantee that a listing is accurate or that a person will do what they say. Items are sold as-is by their sellers.
To the fullest extent the law allows, Wornly is provided "as is" without warranties, and we aren't liable for indirect or consequential losses. Nothing in these terms removes rights you have under consumer-protection law that can't be waived.
If you have a dispute with us, please contact us first at [CONTACT EMAIL] so we can try to sort it out informally — most issues can be resolved that way.
These terms are governed by the laws of [YOUR STATE/COUNTRY], and any disputes not resolved informally will be handled by the courts there, unless the law that protects you as a consumer gives you a different right.
